This HUD NSP Policy Alert provides information on complying with the American Recovery and Reinvestment Act of 2009 (Recovery Act) tenant protections, which are included in the NSP Bridge Notice of June 19, 2009, and the NSP2 Notice of Fund Availability of May 4, 2009. The guidance is the third revision of the original guidance issued September 9, 2009. This revision includes the new definition of "notice of foreclosure" pursuant to Section 1497 of the Dodd-Frank Wall Street Reform and Consumer Protection Act, Pub. L. 111-203. The guidance provides information on how the revised definition of “foreclosed,” included in the Federal Register Notice published on April 9, 2010 expands the properties considered acquired through foreclosure for NSP purposes. The guidance includes an outline of requirements imposed by the Recovery Act, key definitions related to those requirements, methods for documenting compliance, and an overview of how other grantees are managing the requirement. It also includes an optional questionnaire to help grantees walk through tenant protection requirements. Finally, it includes links to related Federal resources.
