CPD Memo: Additional Revision, Extension, and Update of December 2020 and April 2020 Memorandum – Availability of Waivers and Suspensions of the HOME Program Requirements in Response to COVID-19 Pandemic

This memorandum updates and revises the memorandum, Revision, Extension and Update of April 2020 Memorandum Availability of Waivers and Suspensions of the HOME Program Requirements in Response to COVID-19 Pandemic  (the “December 2020 Memo”). The December 2020 Memo extended certain statutory suspensions and regulatory waivers described in the April 2020 Memo, which announced the availability of certain statutory suspensions and regulatory waivers to enable HOME Participating Jurisdictions (PJs) affected by the COVID-19 pandemic to use HOME funds to address immediate housing needs and to help prevent spread of the virus. This memorandum, effective as of September 30, 2021, amends the December 2020 Memo to further revise or extend certain statutory suspensions and regulatory waivers.

CPD Memo: Revision and Extension of April 2020 Memo - Suspensions and Waivers to Facilitate Use of HOME-Assisted TBRA for Emergency and Short-term Assistance in Response to COVID-19 Pandemic

The April 2020 TBRA Memo announced the availability of certain statutory suspensions and regulatory waivers to enable HOME PJs affected by the COVID-19 pandemic to use HOME TBRA to facilitate urgent housing assistance to communities and families experiencing financial hardship. This memorandum, issued on December 4, 2020, extends all statutory suspensions and regulatory waivers outlined in the April 2020 TBRA Memo through September 30, 2021 (the “extended waiver period”), and revises or clarifies several waivers.

Note: The HOME COVID-19 suspensions and waivers issued to facilitate the use of HOME-assisted TBRA for emergency and short-term assistance expires on September 30, 2021. All resources developed under the Emergency HOME TBRA Toolkit (sample templates and forms) are obsolete after September 30, 2021.

CPD Memo: Suspension and Waiver of the HOME Program Consortium Qualification Deadline in Response to COVID-19 Pandemic

This memorandum suspends the HOME Program’s statutory deadline and waives the HOME regulatory deadline for qualification or requalification of urban counties and consortia to provide HOME PJs additional time to complete these processes due to the unanticipated circumstances created by the COVID-19 pandemic.

CPD Memo: Availability of a Waiver and Alternate Requirement for the CAPER for CPD Grant Programs in Response to the Spread of Coronavirus

This memorandum from the Office of Community Planning and Development’s (CPD’s) Acting Assistant Secretary John Gibbs authorizes and explains a waiver of the regulatory requirement at 24 CFR 91.520(a), that within 90-days of the end of a jurisdiction's program year a grantee shall submit to HUD a performance report known as the Consolidated Annual Performance and Evaluation Report (CAPER). The CAPER is associated with several CPD grant programs.

CPD Memo: Availability of Waivers of CPD Grant Program and Consolidated Plan Requirements to Facilitate Recovery from Hurricanes Harvey, Irma, and Maria

This memorandum explains the availability of waivers of certain statutory and regulatory requirements associated with several CPD grant programs to facilitate recovery from Hurricanes Harvey, Irma, and Maria that are the subject of major disaster declarations made under Title IV of the Stafford Act.

CPD Memo: Waiver of 24 CFR 91.105(b)(4) and 24 CFR 91.115(b)(4) for FY 2017 Action Plans for Community Planning and Development Program Funds

This memorandum revises procedures for the submission and review of action plans for FY 2017 funding for CPD grantees. The timing of the enactment for the FY 2017 appropriations act may leave insufficient time for grantees to complete their pre-submission or pre-amendment citizen participation process before the statutory August 16, 2017 submission deadline. To address this potential issue, HUD has issued a waiver of the regulatory 30-day citizen participation public comment period in favor of a 14-day comment period. This waiver applies to all CPD grantees and is in effect only until August 16, 2017.

CPD Memo: System and Regulatory Changes to Eliminate First-In-First-Out Accounting in IDIS

The memorandum describes pending system and regulatory changes in Integrated Disbursement and Information System (IDIS) that will significantly impact the administration of the Community Development Block Grant (CDBG), HOME, Emergency Solutions Grants (ESG) and Housing Opportunities for Persons with AIDS (HOPWA) block grant programs. The HUD Office of the Inspector General (OIG) and the Office of Management and Budget (OMB) have determined that the first-in-first-out (FIFO) accounting methodology used by IDIS does not comply with federal financial standards. In addition, the Government Accountability Office is requiring a change to the way that HOME commitments are calculated.

This memorandum is intended to provide guidance regarding repayment of HOME funds expended for ineligible costs or activities and returning HOME funds drawn down in advance of or in excess of need.

This memorandum explains the effect of the Economic Stimulus Act of 2008 on Federal Housing Administration's (FHA's) Single Family Mortgage Insurance Program (203(b)) limits and their use as a value limit for homeownership activities assisted with HOME funds.

CPD Memo: Joint CPD and FHA Memorandum on Cross-selling FHA programs
