A

Until a program participant submits its first AFH, the program participant must continue to comply with applicable fair housing planning procedures, meaning that it should comply with the exiting Analysis of Impediments (AI) to fair housing choice requirements by having an up-to-date AI, complying with the AI, and taking action to affirmatively further fair housing.

The provision of the new Affirmatively Furthering Fair Housing (AFFH) rule that establishes compliance with existing requirements until the program participants submit its initial AFH is located at 24 C.F.R. § 5.160(a)(3).

If your AFH is due soon you should begin to plan for meaningful community participation in the AFFH fair housing planning process.

For more information concerning preparing for the AFH for Consolidated Plan program participants, please refer to the Transitioning to the New AFFH Process Fact Sheet.
