What happens after HUD makes its final decision regarding an appeal request?

If HUD upholds the unsuitability determination, HUD will:

  1. notify the homeless service provider and the landholding agency of its final decision; and
     
  2. inform the landholding agency that it may proceed with any disposal action, if the initial 20-day holding period has expired.

If HUD reverses the unsuitability determination, HUD will:

  1. notify the homeless service provider and the landholding agency of its determination;
     
  2. post the new suitability (i.e., suitable and available) on the HUD Exchange; and
     
  3. establish a new holding period of 30 days with the landholding agency from the date HUD posts the suitability determination on the HUD Exchange.
