Can an agency establish a policy to charge a fee to clients from out-of-state and not charge in-state clients assuming the agency follows established guidelines for determining a client’s ability to pay?

HUD does not prohibit this, but the agency must be able to justify the additional cost to “out-of-state” clients. HUD does require that all clients are informed of the fee structure in advance of providing the service.
